Estos Términos de servicio («Términos») rigen el uso del sitio web radiobolero.com, la transmisión en vivo de Radio Bolero, las cuentas de socios, el chat de oyentes y los demás servicios que ofrecemos (en conjunto, el «Servicio»). El Servicio lo opera Radio Bolero, Inc. («Radio Bolero», «nosotros»).

Al escuchar la radio, crear una cuenta o usar el chat, aceptas estos Términos. Si no estás de acuerdo, no uses el Servicio.

These Terms of Service ("Terms") govern your use of the radiobolero.com website, the Radio Bolero live stream, member accounts, the listener chat and any other services we provide (together, the "Service"). The Service is operated by Radio Bolero, Inc. ("Radio Bolero", "we", "us").

By listening to the stream, creating an account or using the chat, you agree to these Terms. If you do not agree, please do not use the Service.

Radio Bolero es una emisora de radio por internet que transmite boleros y música romántica en vivo, las 24 horas. Es una transmisión lineal: la programación la elegimos nosotros y no es posible pedir, saltar, repetir ni descargar canciones a voluntad.

Radio Bolero is an internet radio station streaming boleros and romantic music live, 24 hours a day. It is a linear, non-interactive broadcast: we choose the programming, and songs cannot be requested on demand, skipped, replayed or downloaded.

The Service is free. We may change, suspend or discontinue any part of the Service (including programming, the chat or member features) at any time. We do not guarantee that the stream will be uninterrupted or available in every country or on every device.

Puedes escuchar Radio Bolero para tu uso personal y no comercial, en nuestro sitio o en reproductores compatibles mediante los enlaces que ofrecemos. No está permitido:

• grabar, copiar, descargar o «extraer» la transmisión o canciones individuales;
• retransmitir, redistribuir o reproducir la señal en público, en negocios, eventos u otras emisoras, o insertarla en otro sitio o aplicación con fines comerciales, sin nuestro permiso por escrito y las licencias que correspondan;
• eludir medidas técnicas, sobrecargar nuestros servidores o usar programas automatizados para acceder al Servicio;
• usar el Servicio de forma ilegal o que perjudique a Radio Bolero, a otros oyentes o a terceros.

You may listen to Radio Bolero for your personal, non-commercial use, on our website or in compatible players using the links we provide. You may not:

• record, copy, download or "rip" the stream or individual songs;
• rebroadcast, redistribute or publicly perform the stream in businesses, events or other stations, or embed it in another site or app for commercial purposes, without our written permission and any required licenses;
• circumvent technical measures, overload our servers, or use automated tools to access the Service;
• use the Service unlawfully or in a way that harms Radio Bolero, other listeners or anyone else.

La música que transmitimos pertenece a sus artistas, compositores, editoras y sellos discográficos, y se transmite bajo las licencias aplicables. Escuchar la radio no te otorga ningún derecho sobre esas obras.

«RadioBolero» es una marca registrada de Radio Bolero, Inc. The music we stream belongs to its artists, songwriters, publishers and record labels, and is transmitted under applicable licenses. Listening to the station does not give you any rights in those works.

"RadioBolero" is a registered trademark of Radio Bolero, Inc. The station name, logos, design and website text belong to Radio Bolero or its licensors and may not be used without permission. Song and artist names shown on the site come from the stream's metadata and may contain errors.

Para usar el chat debes crear una cuenta gratuita de socio. Para crear una cuenta debes tener al menos 13 años; si eres menor de edad donde vives, necesitas el permiso de tu madre, padre o tutor.

Te comprometes a dar información verdadera, a mantener tu contraseña en secreto y a avisarnos si crees que alguien usó tu cuenta sin permiso. Eres responsable de lo que ocurra con tu cuenta. Una persona, una cuenta: no crees cuentas para hacerte pasar por otra persona.

Puedes dejar de usar tu cuenta en cualquier momento y pedirnos que la eliminemos escribiendo a la dirección de contacto.

A free member account is required to use the chat. You must be at least 13 years old to create an account; if you are a minor where you live, you need permission from a parent or guardian.

You agree to provide accurate information, keep your password confidential, and tell us if you believe someone used your account without permission. You are responsible for activity on your account. One person, one account: do not create accounts to impersonate anyone.

You may stop using your account at any time and ask us to delete it by writing to the contact address below.

Los mensajes del chat los pueden ver los demás socios. Eres responsable de lo que escribes. No publiques:

• insultos, acoso, amenazas, discriminación o contenido sexual u ofensivo;
• spam, publicidad, enlaces engañosos o cadenas;
• datos personales tuyos o de otras personas (teléfonos, direcciones, datos bancarios);
• contenido ilegal o que infrinja derechos de terceros.

Conservas los derechos sobre tus mensajes, pero nos das un permiso gratuito y no exclusivo para mostrarlos, almacenarlos y moderarlos dentro del Servicio. Podemos borrar mensajes y suspender cuentas que no cumplan estas normas, sin aviso previo. No revisamos todos los mensajes y no somos responsables de lo que publiquen otros usuarios.

Chat messages are visible to other members. You are responsible for what you post. Do not post:

• insults, harassment, threats, hate speech, or sexual or offensive content;
• spam, advertising, misleading links or chain messages;
• personal information about yourself or others (phone numbers, addresses, financial details);
• unlawful content or content that infringes anyone's rights.

You keep your rights in your messages, but you give us a free, non-exclusive permission to display, store and moderate them within the Service. We may delete messages and suspend accounts that break these rules, without notice. We do not review every message and are not responsible for what other users post.

Las donaciones son voluntarias y ayudan a mantener la radio al aire. Donar no te da acceso a contenidos, funciones ni beneficios adicionales. Los pagos los procesa un servicio externo (actualmente Cash App), sujeto a sus propios términos; nosotros no recibimos ni guardamos tus datos de tarjeta o de banco.

Donations are voluntary and help keep the station on the air. Donating does not give you access to any additional content, features or benefits. Payments are processed by a third-party service (currently Cash App) under its own terms; we do not receive or store your card or bank details.

Except where the law requires otherwise, donations are non-refundable. If you donated by mistake, contact us and we will do our best to help. Donations are not tax-deductible unless we expressly tell you otherwise in writing.

El Servicio depende de proveedores externos, por ejemplo para la transmisión de audio, las cuentas y el chat, el alojamiento del sitio y los pagos. También ofrecemos enlaces para escuchar en aplicaciones de terceros. The Service relies on outside providers, for example for audio streaming, accounts and chat, website hosting and payments. We also provide links for listening in third-party apps. We do not control those services and are not responsible for their availability, content or practices; your use of them may be subject to their own terms and policies.

Respetamos los derechos de autor. Si crees que algún contenido del Servicio infringe tus derechos, envíanos un aviso a info@radiobolero.com que incluya: tu nombre y datos de contacto; la obra protegida; el contenido que consideras infractor y dónde se encuentra; una declaración de que crees de buena fe que el uso no está autorizado; una declaración, bajo pena de perjurio, de que la información es exacta y de que eres el titular o estás autorizado a actuar en su nombre; y tu firma física o electrónica.

Podemos retirar el contenido señalado y cerrar las cuentas de quienes infrinjan derechos de forma reiterada.

We respect copyright. If you believe content on the Service infringes your rights, send a notice to info@radiobolero.com that includes: your name and contact details; the copyrighted work; the allegedly infringing material and where it is located; a statement that you have a good-faith belief the use is not authorized; a statement, under penalty of perjury, that the information is accurate and that you are the owner or authorized to act on the owner's behalf; and your physical or electronic signature.

We may remove the identified material and terminate the accounts of repeat infringers.

To provide the Service we keep the information you give us when you sign up (name, email and any optional details you choose to share), your chat messages, and basic technical data needed to stream and secure the site. We use your email to verify your account, for messages about the Service and, if you agreed, for station news; you can unsubscribe at any time. We do not sell your personal information.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE.

Y SUS DIRECTIVOS, EMPLEADOS Y COLABORADORES NO SERÁN RESPONSABLES DE DAÑOS INDIRECTOS, INCIDENTALES, ESPECIALES, CONSECUENTES O PUNITIVOS, NI DE LA PÉRDIDA DE DATOS O GANANCIAS, DERIVADOS DEL USO O LA IMPOSIBILIDAD DE USAR EL SERVICIO. AND ITS OFFICERS, EMPLOYEES AND CONTRIBUTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA OR PROFITS, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS (US$100) OR THE AMOUNT YOU DONATED TO US IN THE TWELVE MONTHS BEFORE THE CLAIM.

Some jurisdictions do not allow certain limitations; where that is the case, they apply only to the extent permitted.

Aceptas defender e indemnizar a Radio Bolero, Inc. frente a reclamos, daños y gastos razonables (incluidos honorarios de abogados) que surjan de tu incumplimiento de estos Términos, de tus mensajes en el chat o de tu uso indebido del Servicio.

You agree to defend and indemnify Radio Bolero, Inc. against claims, damages and reasonable expenses (including attorneys' fees) arising from your breach of these Terms, your chat messages, or your misuse of the Service.

Podemos suspender o cancelar tu cuenta o tu acceso al Servicio si incumples estos Términos o si debemos hacerlo por motivos legales o técnicos. Las secciones que por su naturaleza deban seguir vigentes (por ejemplo, música y derechos, exclusión de garantías, limitación de responsabilidad, indemnización y ley aplicable) seguirán vigentes tras la terminación.

We may suspend or close your account or your access to the Service if you break these Terms or if we must do so for legal or technical reasons. Sections that by their nature should survive (for example music and rights, disclaimers, limitation of liability, indemnity and governing law) will survive termination.

Podemos actualizar estos Términos. Publicaremos la nueva versión en esta página con su fecha de vigencia y, si los cambios son importantes, lo avisaremos en el sitio o por correo a los socios. Si sigues usando el Servicio después de la fecha de vigencia, aceptas la versión actualizada.

We may update these Terms. We will post the new version on this page with its effective date and, for significant changes, give notice on the site or by email to members. If you keep using the Service after the effective date, you accept the updated Terms.

Estos Términos se rigen por las leyes del Estado de Carolina del Norte (EE. UU.) y por las leyes federales de los Estados Unidos aplicables, sin tener en cuenta sus normas sobre conflicto de leyes. Cualquier disputa relacionada con el Servicio se resolverá exclusivamente en los tribunales estatales o federales ubicados en Carolina del Norte, y ambas partes aceptan su jurisdicción. These Terms are governed by the laws of the State of North Carolina, USA, and applicable U.S. federal law, without regard to conflict-of-law rules. Any dispute relating to the Service will be resolved exclusively in the state or federal courts located in North Carolina, and both parties consent to their jurisdiction. This does not limit any rights you have under the consumer protection laws of the place where you live.

Estos Términos son el acuerdo completo entre tú y Radio Bolero sobre el Servicio. Si alguna parte no fuera válida, el resto seguirá vigente. Que no ejerzamos un derecho no significa que renunciemos a él. No puedes ceder estos Términos sin nuestro permiso; nosotros podemos cederlos en caso de reorganización o venta.

Estos Términos se publican en español e inglés. Si hubiera alguna diferencia entre ambas versiones, prevalecerá la versión en inglés.

These Terms are the entire agreement between you and Radio Bolero regarding the Service. If any part is held invalid, the rest remains in effect. Our failure to enforce a right is not a waiver of it. You may not assign these Terms without our permission; we may assign them in connection with a reorganization or sale.

These Terms are published in Spanish and English. If the two versions differ, the English version controls.
